In the suit number I/722/2021, the claimants are seeking for a declaration that the purported appointment and investiture of Justice Abimbola by the national officers without the concurrence of the Oyo State Scout Council and the Executive Committee of the Oyo State Scout Council is unlawful, illegal and of no effect contrary to the Scouts Constitution.

The claimants also seek a declaration that “all steps and actions, including but not limited to the appointment of Tella, Segun Fatope and Edward Adesina and others by Justice Munta Ladipo Abimbola as Caretaker Committee for Oyo State Scout Council in purported furtherance of the Justice Abimbola’s unlawful appointment and investiture as President of the Oyo State Scout Council are all unlawful, ultra vires, illegal, void and of no effect whatsoever.”

The claimants, including Funso Ogunkeye, Adetunji Adepeju, Bamidele Oladoja and others are seeking an order setting aside all steps and actions, including but not limited to the appointment of Caretaker Committee members by Justice Munta Abimbola and his investiture as President of the Oyo State Scout Council are unlawful, untra vires, illegal, void and of no effect whatsoever, among other reliefs.

Recalled that the matter filed on August 2 only got assigned to High Court 7, Ring Road, Ibadan, after four months in the Court Registry, following a peaceful protest by Scouts who felt intimidated by the prolonged failure to assign the suit.
